Who fills it in
Both spouses together, when they agree to divorce. The Marriage Law, as amended by Law 1(I)/2023, lets the application be filed jointly or by one spouse, at least six months after the wedding, and both declare their consent before the court. One party must live in Cyprus for a Cyprus Family Court to hear the case. If the spouses cannot agree, the case starts on Form 1 instead.
What goes with it
- The copies the registry needs for the court file
- If a lawyer represents a spouse living in Cyprus: the lawyer's appointment form (rule 3(3))
- The court fee

Common mistakes
- Filing Form 3 when one spouse has not agreed: a contested divorce starts on Form 1.
- Not listing a pending custody or maintenance case between you.
- Forgetting the lawyer's appointment form when a lawyer represents a spouse living in Cyprus.
- Applying less than six months after the wedding: the law does not allow it yet.
- Coming without arrangements for minor children: the court needs a custody and contact decision, or a joint application for one, to decide at the same sitting.
