Common mistakes

  • Treating crypto-to-crypto swaps as tax-free: each swap is a disposal
  • Carrying a crypto loss forward: losses offset only gains of the same year
  • Missing the cost of each coin across exchanges and wallets
  • Using the flat rate for mined crypto: it is taxed under the normal rules

What affects the cost

Questions

Did the 2026 reform change crypto tax?

Yes. From 1 January 2026 gains from disposing of crypto-assets are taxed at a flat 8% (not for crypto acquired by mining). Losses offset only crypto gains of the same year.

Will exchanges report to the Tax Department?

Yes. Under DAC8, in force since April 2026, crypto-asset service providers will report to the Tax Department; deadlines are still to be announced.

What counts as a disposal of crypto?

Selling crypto, giving it away, swapping one crypto-asset for another and paying with crypto all count (Income Tax Law, section 20E). Simply holding it does not.

How much tax on a crypto gain?

Buy bitcoin for €20,000 in 2026 and sell it for €50,000: the €30,000 gain is taxed at 8%, so €2,400. A €5,000 loss on another coin in the same year lowers the gain to €25,000 and the tax to €2,000. A loss from an earlier year cannot be used.
