Questions
Do I withhold tax when paying a foreign freelancer from Cyprus?
Usually not. Cyprus levies 10% on non-residents' fees for technical services sourced in Cyprus, subject to conditions, and on income from a profession exercised in Cyprus by a non-resident individual.
Is there withholding tax on royalties paid abroad from Cyprus?
Only for rights used within Cyprus: 10%, or 5% for cinematograph films. Tax treaties or the EU Interest and Royalty Directive can reduce it.
What if the contractor is in an EU-blacklisted country?
Payments to companies in EU non-cooperative jurisdictions face 17% on interest and 10% on royalties and similar payments.
Does the 10% apply if the services go through a Cyprus branch?
No. It does not apply where the services are performed through a permanent establishment in Cyprus, or between associated companies under the EU Interest and Royalty Directive.
When should a contractor become an employee?
When the work looks like employment; we assess the risk for your case.
