  • For contracts signed from 12 December 2023 the seller must attach a search certificate dated within five working days of the contract.

What a title deed is and who keeps the register

A title deed is the official record of who owns a registered piece of land or a unit in a building. The register is kept by the Department of Lands and Surveys (DLS) of the Ministry of Interior, which most people call the Land Registry.

The DLS has its headquarters in Nicosia and six District Land Offices, one per district. The Kyrenia and Famagusta offices are temporarily based in Nicosia and Paralimni, because their original records remain in the occupied areas. Applications are handled at the district offices from 07:45 to 13:00; phone information is on 17100, or +357 22 80 49 00 from abroad.

CyprusPermit is not the DLS and not a law firm. We plan the steps and gather the documents; a licensed Cyprus lawyer acting only for you checks the property and files at the Land Registry.

Checking a property: search certificates

The DLS issues a search certificate that shows the registered owner and, if you ask for it, the encumbrances and prohibitions on the property: mortgages, deposited sales contracts, court orders and similar. Official fees:

  • one property of a specific owner: €10 simple, €15 with encumbrances and prohibitions;
  • all property of a specific owner: €10 or €15 for one district, €20 or €30 for the whole of Cyprus.

You apply online through the DLS e-services with a verified CY Login account, or by email to the district office with a signed application whose signature is certified and a copy of your ID or passport. The certificate is saved in the application as an unofficial PDF for 120 days.

Not everyone can search. The owner can, and so can a person with a legal interest under Article 51A of the Immovable Property Law (Cap. 224), who must prove it. A buyer usually sees the certificate through the seller: for contracts signed from 12 December 2023 the seller must attach a search certificate with encumbrances and prohibitions, dated within five working days of the contract.

Lodging the sales contract

When you buy a property that has no separate title deed yet, or the transfer has to wait, you sign a sales contract and lodge it at the District Land Office. Once lodged, the Sale of Immovable Property (Specific Performance) Law 81(I)/2011 protects you if the seller does not keep to the contract.

  • Fee: €50 for depositing the contract.
  • Deadline: within six months of signing, unless a court order allows a late deposit.
  • Documents: form Δ.Ε.314 for a sale, the contract with original signatures, the site plan and, for a unit, the floor plans signed by both sides, and ID copies.
  • Stamp duty: needed only if at least one party signed before 1 January 2026.

Since 12 December 2023, Law 132(I)/2023 adds protection for buyers where a mortgage or another contract was already registered on the property. Your lawyer checks whether it applies to your purchase.

Transfer at the District Land Office

The transfer is the moment the title passes into your name. It is done at the District Land Office by appointment, with both sides or their attorneys. The DLS asks for:

  • the Declaration of Transfer, form N.270;
  • a tax clearance certificate, form N.313, stamped by the Tax Department;
  • certificates that municipal or community taxes, sewerage fees and water fees are paid;
  • copies of the ID cards, ARCs or passports of everyone involved, with the originals on the day;
  • the lender's consent or a release document if the property is mortgaged;
  • for a buyer who is a foreign person under Cap. 109, the permit to acquire property.

Transfer fees on a sale are charged on the price or the market value: 3% up to €85,000, 5% from €85,001 to €170,000 and 8% above, with a 50% discount. No transfer fee is charged when VAT was paid on the same sale. If the DLS thinks the declared price is below market value, it sets the value itself; you pay on that value and may object.

If someone signs for you under a power of attorney, a general power of attorney is deposited for €50 and a special one for free; the principal's signature must be certified. Work out the full cost with the property costs calculator.

Properties without title deeds

Many new-build homes are sold before the developer has separate title deeds. Your protection in the meantime is the lodged sales contract. Your lawyer also checks whether the developer's land carries a mortgage and how it will be released.

If the seller will not transfer, a buyer with a court order for specific performance can apply to the Director of the DLS. The fees are €10 for the application, €5 for each title deed of each owner and a valuation fee. You need the court order (valid for one year), receipts for municipal, sewerage and water charges and form N.313.

For so-called trapped buyers, Law 139(I)/2015 lets the DLS transfer the deed to a buyer who paid in full, even if the developer's mortgage is still on the land. It applies to contracts deposited by 31 December 2014. Three conditions must be met: the price is fully paid, a separate title deed exists, and the buyer has paid the taxes due under the contract. The DLS notifies everyone concerned, who have 45 days to object; buyer and seller then have 60 days to complete the transfer, and the buyer can pay the transfer fees without the seller's consent.

How we help

We plan the order of steps, collect the papers and keep the timeline. A licensed Cyprus lawyer orders the search certificate, reviews the title, permits and the developer, lodges the contract and attends the transfer. If you are abroad, the lawyer prepares a power of attorney. See property purchase support. Figures checked 23 October 2026 against the DLS pages listed below.

Questions

How much is a Land Registry search in Cyprus?

A search certificate for one property costs €10, or €15 with encumbrances and prohibitions. A search of everything a person owns costs €10 or €15 for one district and €20 or €30 for the whole of Cyprus.

Can I check a property I do not own?

Only the owner or a person with a legal interest under Article 51A of Cap. 224 can get a search certificate. As a buyer you usually get it from the seller: for contracts signed from 12 December 2023 it must be attached to the contract and dated within five working days.

How much does it cost to lodge a sales contract?

The Land Registry charges €50. Lodge it within six months of signing, otherwise you need a court order to deposit it late.

Where is the Famagusta land office?

The Famagusta District Land Office works temporarily from 245 1st April Avenue, 5280 Paralimni. Phone 23 84 07 00.

What if my developer never issued the title deed?

A lodged contract protects you meanwhile. If the contract was deposited by 31 December 2014 and you paid in full, the trapped buyers law 139(I)/2015 lets the Land Registry transfer the deed to you even if the developer's mortgage remains. Otherwise a lawyer can seek specific performance through the court.
